The School Song

  1. Competition Terms and Conditions
    1. The title of the Competition is The National School Song 2026. (the “Competition”).
    2. The promoter of the Competition is The School Song UK Ltd , a company registered in England and Wales with company number 15067245 (the “Promoter”).
    3. The cost of entry to the Competition is £95 (the “Entry Fee”).
    4. The designated charities for the National School Song 2026 is Great Ormond Street (the “Designated Charity”).
    5. In these terms:
      1. ‘the School’ means the school identified in the registration form;
      2. you’ means the School, including the person authorised to act on behalf of the School as identified in the registration form and any other person purporting to act on behalf of the School;
      3. we’ ‘our’ and ‘us’ means the Promoter;
      4. the Website means the School Song UK website at https://www.theschoolsonguk.com/

  2. How to enter
    1. The Competition will run from 1st September 2025 (the “Opening Date“) to end May 2026 (the “Closing Date“) inclusive. The Promoter may extend the Closing Date at its discretion by publishing a notice on the Website. In which case the “Closing Date” for the purpose of these terms shall be the date published on the Website.
    2. All Competition entries must be received by the Promoter in accordance with the process set out at clause 4 no later than the Closing Date.
    3. Any entries received after the Closing Date will only be considered at the sole discretion of the Promoter.
    4. To enter the Competition you must:
      1. create an online account for the School via our registration page [on the website];
      2. pay the Entry Fee [on the website] (once the Entry Fee has been received by the Promoter you will receive a confirmation email);
      3. submit your School’s Competition entry [on the website] by Closing Date (once your entry has been successfully submitted you will receive a confirmation email from the Promoter); and
      4. agree to participate in the final (described in more detail in clause 4.2).
    5. By registering on the Website you agree to be bound by these Competition terms and conditions.
    6. To submit your School’s entry into the Competition you must pay the Entry Fee on registration.
    7. The Entry Fee must be received by the Promoter in full and cleared funds no later than the Closing Date. The Promotor may disqualify an entry if the Entry Fee has not been received in cleared funds by the Closing Date.
    8. Please only pay the Entry Fee if you are committed to entering the Competition; once paid, the Entry Fee is non-refundable.

    10. Please check your Competition entry carefolly before submitting. Once submitted, entries cannot be altered, amended or returned.
    11. The Promoter will not accept:
      1. responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      2. proof transmission as proof of receipt of entry to the Competition.
  3. Eligibility
    1. The Competition is open to all Schools in the UK.
    2. By registering with the Website:
      1. you confirm that you are authorised to act on behalf of the School in whose name the entry is submitted (the Promoter may require you to provide proof of such authorisation); and
      2. you accept these Competition terms and conditions on behalf of the School.
    3. By submitting its entry to the Competition, the School grants the rights to the Promoter as set out in clause 7. These rights apply to all entries whether or not the School also wins a prize.
    4. You are free to submit more than one entry provided the Entry Fee is payable per entry.
    5. The Promoter will not accept Competition entries that are:
      1. automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
      2. professionally created by a third party for a fee;
      3. created by third parties other than individuals directly linked to the School (pupils, teachers, parents);
      4. illegible, have been altered, reconstructed, forged or tampered with;
      5. photocopies and not originals; or
      6. incomplete
    6. Once submitted, Competition entries cannot be altered, amended or returned.
    7. You agree not to publicise or otherwise promote your Competition entry or any part of it prior to the final except with the prior written consent of the Promoter (such consent not to be unreasonably withheld or delayed).
    8. You may withdraw your entry from the Competition prior to the final, and by doing so you acknowledge that the Entry Fee is non-refundable.
    9. The Promoter reserves all rights to disqualify you or your entry if it reasonably determines that your conduct is contrary to the spirit or intention of the Competition or in breach of these terms and conditions.
  4. Winners
    1. The Competition entries will be judged by a panel of judges appointed by the Promoter at its sole discretion (the “Judges”). The identity of the Judges will be published on the Website. The Promotor may replace any Judge at any time and the identity of the replacement Judge will be published on the Website.
    2. The Judges will select ten (10) entries to participate in the final. The final may be a live performance or online at the discretion of the Promotor. The venue and dates for the final will be published on the Website. If you are selected to participate in the final you will be notified by email to the address provided on registration.
    3. To be eligible to win a prize the School must take part in the final. If you are unable to participate in the final you agree that the Entry Fee is not refundable.
    4. The winning entry will be announced at or immediately after the final.
    5. The decision of the Judges is final and no correspondence or discussion will be entered into.
    6. The Promoter will contact the winning school with a copy of the publishing agreement as soon as practicable after the Judges decision, using the email address provided by the School on registration.
    7. The Promoter will publish the name of the winning school and the runners up on the Website after the final.
    8. The Promoter does not accept any responsibility if the School is unable to participate in the final or is otherwise unable to take up a prize.
  5. The Prizes
    1. The total value of the prizes will depend on the total number of entries submitted, after deduction of costs incurred by the Promotor and charitable donations.
    2. The prizes are:
      1. First Prize: a professional recording and promotion of your School’s entry song.
      2. Five (3) runner’s up prizes in the form of vouchers. The actual value of the vouchers is at the discretion of the Promoter, subject to the provisions clause 5.1, and will be published on the Website after the Closing Date.
    3. It is a condition of the Competition that the winner of the First Prize will enter a publishing agreement with the Promoter on such terms as the Promotor may reasonably require.
    4. The Promoter will meet the costs of creating the recording of the winning song and the reasonable costs (at its discretion) of promoting the winning song in accordance with the publishing agreement.
    5. All proceeds from commercialisation of the winning song pursuant to the publishing agreement (or otherwise) will be shared as follows:
      1. 50% to the School;
      2. 25% to the Promoter; and
      3. 25% to the Designated Charity.
    6. The Promoter may (but is not obliged to) enter a publishing agreement on substantially the same terms as the winning entry with any School submitting an entry to the Competition.
    7. If the School does not win the First Prize you will give the Promoter first refusal to promote or otherwise commercialise your Competition entry at its discretion.
    8. If you do not have a publishing agreement with the Promoter, you may promote your entry in such form as you see fit, provided that you let the Promoter know in advance of your intention to do so.
    9. The prizes do not include:
      1. Any costs incurred by the School in attending the final.
      2. Any costs incurred by the School in entering the publishing agreement.
      3. Any costs incurred in addition to those set out above that are incidental to the fulfilment of the prize – such costs are the responsibility of the School.
    10. The prizes are not negotiable or transferable.
    11. The provisions of clause 7 apply to all entries not just the winning entry(ies).
  6. Limitation of liability
    1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or any person acting on behalf of or connected with the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of entering this Competition or taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.
    2. Without prejudice to the foregoing, except for personal injury or death caused by the Promotor’s negligence or for fraud, the Promoter limits its liability under or in connection with these Competition terms and conditions to the sum of £1.
  7. Ownership of Competition entries and intellectual property rights
    1. All Competition entries and any accompanying material submitted to the Promoter will remain the property of the School.
    2. By submitting a Competition entry and any accompanying material, the School acknowledges and agrees:
      1. the Competition entry is its own original work;
      2. it is the sole owner of all intellectual property rights in the Competition entry and accompanying materials and has the right to grant the licence set out in these Competition terms and conditions to the Promoter; and
      3. to waive (or procure the waiver of) absolutely all moral rights in and to your Competition entry or otherwise arising in connection with your entry to which the School or any other person may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
    3. The School agrees that the Promoter may, in their sole discretion, make the School’s entry available on its website and in any other media, whether now known or invented in the future, in connection with any publicity of the Competition or any other competition run by the Promoter.
    4. The School grants the Promoter a non-exclusive, worldwide, folly transferable, paid up, irrevocable licence in perpetuity, for the foll period of the intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the Competition entry and any accompanying materials for such purposes as the Promoter shall determine.
    5. The School hereby indemnifies (and shall keep indemnified) the Promoter for any costs, losses or liabilities (including reasonable legal fees) incurred by the Promoter arising out of or in connection with a breach by the School of the provisions of this clause.
  8. Data protection and publicity
    1. The Promoter will process personal information in accordance with the School Song UK privacy notice as published on the Website a copy of which can be viewed here.
    2. You shall ensure that a copy of the Promoter’s privacy policy is provided to any pupils, parents or other persons participating in the Competition or whose personal data is shared with the Promoter in connection with the Competition.
    3. The Promoter may use images from the final (including any live performance) and during the recording of the winning song and the School shall obtain all relevant consents and waivers from participating pupils and parents as the Promoter may reasonably require to enable the Promoter to exercise its rights under the Competition terms and conditions and the publishing agreement.
  9. General
    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition, in such circumstances the Entry Fee remains non-refundable.
    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize Competition where it becomes necessary to do so.
    3. These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in England and Wales.
